Throughout the site, the terms “we”, “us” and “our” refer to Erti KL Services. By using or participating in the Erti website or any of its services, tools, or clothing exchange program (collectively, the “Erti site”) you agree to be bound by the Terms and Conditions set out below and on our FAQ page.
Erti reserves the right to change or alter the terms and conditions of www.ertikl.com at any time with immediate effect upon publication on this website. Unless otherwise stated, all retails and fees are quoted in Malaysia Ringgit (MYR).

PRODUCTS
We have made every effort to display as accurately as possible the colours, images and details of the items on our website. We cannot guarantee that your computer monitor’s display of any colour will be accurate. We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

You agree to indemnify, defend and hold harmless Erti and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party including the use of the Erti site. 

PRIVACY
We collect, store, and use your personally identifying information only as described in our Privacy Policy, which forms part of and is subject to this Agreement. Please read the Privacy Policy. 

INTERNATIONAL DELIVERIES
You are responsible for assuring that the product can be lawfully imported to the destination country. When ordering from www.ertikl.com, the recipient is the importer of record and must comply with all laws and regulations of the destination country. Additional charges for customs clearance must be borne by the recipient; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country. Please contact your local customs office for further information. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates.

CHANGES TO TERMS & CONDITIONS
You can review the most current version of the Terms and Conditions at any time. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.

1. In the event that you have encountered any cases of item damages, defects or for any incorrect delivery, we are happy to assist you with return and refund processing, strictly subject to the following conditions:
   » Labels / tags are still intact with the items

   » All returning items MUST be returned in their original conditions – unused, unwashed and unaltered. Our team will inspect  thoroughly once the items have been returned from our side.
   
   2. Items of sales and purchases made under promotions or with discount coupons / vouchers are non-refundable.
   
   3. All items must be returned within seven (7) days from the date of official receipt.
   
   4. Kindly fill in our Return & Refund Form to proceed with the return and refund processes. Alternatively, please contact our Customer Service Specialist via email at [email protected]. Kindly provide us with the following information:

   » Reason for returns
   
   5. Postage costs for the return of damaged items due to Erti’s negligence will be borne by us. Kindly assist to send a receipt for processing.
   
   6. You must notify us for any reshipment for the return made and provide us with the Tracking Number. You must be liable for ensuring all the items are safely packed and delivered.
   
   7. The return items will be processed within seven (7) working days upon receipt of the returned items. Our team will inspect the items thoroughly and communicate with you with regards to the refund processes via email as soon as possible.
   
   8. All return items will be refunded with an e-gift voucher which can be redeemed through our site www.ertikl.com, valid for 12 months.

1. All prices on our website are NOT inclusive of shipping. Shipping costs will automatically be added during checkout based on the delivery area and the volumetric weight of the package.
   
   
2. We will try our best to deliver your items within the delivery period. However, note that during peak periods, this may not be possible. We use NinjaVan as our chosen and trusted delivery partner and deliveries which can be easily tracked on their website at https://www.ninjavan.co/en-my/tracking.
   
   
3. Please be informed that NinjaVan uses volumetric weight to calculate the courier charge prices. Please note that estimated delivery times are to be used as a guide only and commences from the date of dispatch. Erti will not be liable for any delays caused by the destination customs clearance process.
   
   
4. Should there be any custom duties and/or any other taxes to be paid for with regards to the order, Buyer agrees to bear all the relevant cost(s) and pay directly to the respective authorities.
